Today in New York, International Criminal Court (ICC) Prosecutor, Luis Moreno-Ocampo, told the United Nations Security Council that the Government of The Sudan is not cooperating and asked the Security Council to send today a strong and unanimous message to the Government of the Sudan, requesting compliance with Resolution 1593, requesting the execution of the arrest warrants.

“Sudan has not arrested Harun and Kushayb” the Prosecutor said.  In his statement to the Council, the Prosecutor reiterated the fact that the Government of The Sudan, as the territorial state, has a legal duty to arrest and surrender Ahmad Harun and Ali Kushayb to the ICC.

Massive crimes continue to be committed in Darfur today. All information points not to isolated acts but to a pattern of attacks by Sudanese officials against civilians, in particular the 2.5 million displaced people.

“In Darfur in 2003 - 2004, we witnessed the first phase of the criminal plan coordinated by Ahmad Harun. Millions of people were forced out of their villages and into camps. In the second phase – happening right now in front of our eyes –Ahmad Harun is controlling the victims inside the camps, controlling their access to food, humanitarian aid and security; attacks against the civilians and the displaced in particular take multiple forms; women are raped; emerging local leaders are targeted; the displaced are surrounded by hostile forces; their land and homes are being occupied by new settlers. The rationale is the same as before: target civilians who could be rebel supporters.”

Victims are left with no hope for the present and no prospects for the future.  This is how entire communities are being destroyed in full sight of the international community.

Calling it chaos or sporadic violence or inter-tribal clashes is a cover up.

“Harun has been maintained in a position of control over civilians in camps” The Prosecutor said. There is more. As of 18 November, the official website of the Sudanese Government announced that Ahmad Harun has been appointed to the UNAMID national monitoring mechanism group, overseeing the deployment of UNAMID.  The Government of the Sudan is granting more responsibilities to an individual indicted by the Court, in particular responsibilities that will affect the security of peacekeepers and humanitarian personnel. “

“Harun is a key actor in the present crimes in Darfur, but he is not alone.” The Prosecutor said.  “I will investigate those who bear the greatest responsibility in present crimes, those who actively support him, those who instruct him.  This will be my second investigation in Darfur.   This will be my new case. “

“Harun must be removed from office, arrested and surrendered to the Court. This will break the system.  Until he is arrested and surrendered to the Court, crimes coordinated by Harun will affect delivery of humanitarian assistance, threaten peacekeepers and international personnel.” the Prosecutor said.  “As long as Harun remains free in Khartoum, there will be no comprehensive solution in Darfur”.

Today, we have a new tool, a permanent Court.  It is an opportunity to use the law to prevent atrocities.” It is the only realistic, pragmatic solution for Darfur.

The Prosecutor also informed the Security Council that he will investigate attacks against the AU and UN peacekeepers, including by rebel forces. This will be his third investigation in Darfur.

The International Criminal Court is an independent, permanent court that investigates and prosecutes persons accused of the most serious crimes of international concern, namely genocide, crimes against humanity and war crimes if national authorities with jurisdiction are unwilling or unable to do so genuinely.   The Office of the Prosecutor is currently investigating in four situations:  The Democratic Republic of Congo, Northern Uganda, the Darfur region of Sudan, and the Central African Republic, all still engulfed in various degrees of conflict with victims in urgent need of protection.

Pour le Procureur de la CPI, « des crimes à grande échelle continuent d’être commis au Darfour en ce moment-même, le Soudan ne respecte pas la résolution 1593 du Conseil de sécurité et ne coopère pas avec la Cour »

Dans un discours prononcé aujourd’hui à New York devant le Conseil de sécurité des Nations Unies, Luis Moreno-Ocampo, le Procureur de la Cour pénale internationale (CPI) a déclaré que le Gouvernement du Soudan ne coopérait pas et a demandé au Conseil d’adresser un message ferme et unanime aux autorités soudanaises pour leur demander de respecter la résolution 1593 et d’exécuter les mandats d’arrêt.

« Le Soudan n’a arrêté ni M. Harun, ni M. Kushayb », a indiqué le Procureur. Dans sa déclaration au Conseil, le Procureur rappelait que le Gouvernement du Soudan, en tant qu’État territorial, était légalement tenu d’arrêter Ahmad Harun et Ali Kushayb et de les remettre à la CPI.

Des crimes à grande échelle continuent d’être commis au Darfour en ce moment-même. Tous les renseignements renvoient non pas à des actes isolés, mais bien à une pratique systématique d’attaques menées par des agents soudanais contre des civils, en particulier contre les 2,5 millions de personnes déplacées.

« En 2003 et 2004, nous avons été les témoins, au Darfour, de la première étape du plan criminel orchestré par Ahmad Harun. Des millions de personnes ont été contraintes de quitter leur village pour se réfugier dans des camps. Pour la deuxième étape, qui se déroule aujourd’hui même sous nos yeux, Ahmad Harun exerce son contrôle sur les victimes à l’intérieur des camps, dont il règlemente l’accès à la nourriture, à l’aide humanitaire et à la sécurité. Les attaques contre les civils, en particulier les personnes déplacées, prennent de multiples formes. Les femmes sont violées. Les dirigeants locaux sont pris pour cible dès lors qu'ils se manifestent. Les personnes déplacées sont entourées de forces hostiles, leurs terres et leurs foyers sont occupés par de nouveaux occupants. La logique n’a pas changé : s’en prendre aux civils qui pourraient appuyer les rebelles. »

Les victimes sont privées de tout espoir pour le présent et de toute perspective d’avenir. Voilà comment des groupes entiers sont détruits sous les yeux de la communauté internationale.

Qualifier cette situation de chaos, de violence sporadique ou de heurts entre tribus n’est qu’une façon de se voiler la face.

« M. Harun a toujours la possibilité d’exercer un contrôle sur les civils dans les camps, a déclaré le Procureur. Cela ne s’arrête pas là. Le 18 novembre, un avis sur le site web officiel du Gouvernement soudanais annonçait la nomination d’Ahmad Harun au groupe responsable du mécanisme national de surveillance de la MINUAD, chargé de superviser le déploiement de la mission. Le Gouvernement du Soudan accorde de nouvelles responsabilités à une personne inculpée par la Cour, qui plus est des responsabilités qui touchent à la sécurité des soldats chargés du maintien de la paix et du personnel humanitaire. »

« M. Harun joue un rôle central dans les crimes commis actuellement au Darfour, mais il n’est pas seul, a indiqué le Procureur. J’enquêterai à propos des personnes qui portent la responsabilité la plus lourde dans les crimes commis en ce moment, des personnes qui lui offrent un soutien actif, de celles qui lui donnent des instructions. Ce sera ma deuxième enquête au Darfour, une nouvelle affaire. »

« M. Harun doit être limogé, arrêté et remis à la Cour, ce qui permettra de briser le système. Aussi longtemps que M. Harun ne sera pas arrêté et remis à la Cour, les crimes dont il est le chef d'orchestre continueront d'entraver l'aide humanitaire et de menacer les soldats chargés du maintien de la paix et le personnel international, a ajouté le Procureur. Aucune solution globale n’existera pour le Darfour tant que M. Harun sera libre de ses mouvements à Khartoum. »

« Nous disposons aujourd’hui d’un nouvel outil, une cour permanente, qui nous offre la possibilité d’utiliser la loi pour empêcher que des atrocités soient commises. » Il s’agit de la seule solution réaliste et pragmatique pour le Darfour.

Le Procureur a également porté à la connaissance du Conseil de sécurité qu’il allait mener une enquête à propos d’attaques commises contre les soldats de la paix de l’Union africaine et des Nations Unies, y compris par les forces rebelles. Ce sera sa troisième enquête au Darfour.

La Cour pénale internationale est une cour permanente et indépendante qui mène des enquêtes et engage des poursuites à l’encontre de personnes accusées des crimes les plus graves ayant une portée internationale - génocide, crimes contre l’humanité et crimes de guerre - pour autant que les autorités nationales compétentes n’aient ni la capacité ni la volonté de le faire véritablement. Le Bureau du Procureur mène en ce moment des enquêtes à propos de quatre situations : République démocratique du Congo, Nord de l’Ouganda, Darfour (Soudan) et République centrafricaine. Tous ces pays restent, à des degrés divers, engagés dans des conflits dont les victimes ont un besoin urgent de protection.
