    Sudanese Demonstrations in Cairo

    On Thursday 29 September 2005, a group of around 20 Sudanese gathered in the park opposite Mostapha Mahmoud Mosque in Mohandessin close to UNHCR office. The demonstrators were holding placards reading, among other things, “No to voluntary repatriation to Sudan,” “We want resettlement” and “No to local integration in Egypt,” as well as a number of abusive and threatening messages directed at UNHCR. By 3 October, when UNHCR held the first meeting with a group of five self-appointed leaders of the demonstration, the numbers of the demonstrators had increased to around 300, and by 9 October to nearly 1,500 during peak hours in the mid-afternoon and during Iftar time. At present, some 800 to 900 Sudanese continue to gather in the park. From the information available to UNHCR, two facts are clear. Firstly, the vast majority of the Sudanese demonstrators are southern Sudanese. Secondly, a great many of them are unsuccessful asylum-seekers (the so-called “closed files”) who are not of concern to UNHCR and new arrivals who have registered themselves as refugee applicants with the hope of immigration to America or Australia.

    What are the demands of the Sudanese demonstrators?

    1. Sudanese refugees reject any notion of voluntary repatriation.
    2. Sudanese refugees reject local integration in Egypt.
    3. UNHCR must find solutions to all the problems facing Sudanese refugees and asylum-seekers in Egypt or, failing that, resettle all of them to third countries.
    4. UNHCR must reopen the “closed files” of all Sudanese failed asylum-seekers (i.e., those cases who have been finally determined not to be refugees under either the 1951 Convention or the OAU Convention. There are about 20,000 unsuccessful asylum-seekers believed to be in Egypt illegally).
    5. UNHCR must not apply any new policy to Sudanese relating to the peace agreement in South Sudan (e.g. suspension of RSD).
    6. All Sudanese asylum-seekers should receive the same treatment regardless of whether they originate from the south, Darfur or the north.
    7. The demonstrators reject the “Four Freedoms” Agreement signed between Sudan and Egypt - a reciprocal agreement on freedom of movement, residence, employment and property ownership.
    8. The demonstrators want a new organization/association to assist Sudanese refugees and asylum-seekers.
    9. The demonstrators call for UNHCR protection against Sudanese officials whom they believe to be operating in Egypt.
    10. UNHCR should register all newly arriving Sudanese would-be asylum-seekers “on the spot,” without appointment.
    11. UNHCR must investigate the alleged disappearance of Sudanese refugees and asylum-seekers.
    12. The demonstrators condemn the frequent arrest and detention of Sudanese in Egypt without charges.
    13. UNHCR should stop holding meetings with Sudanese community leaders and community-based organizations to discuss about voluntary repatriation or local integration.
    14. There should be no police officers guarding UNHCR premises.
    15. UNHCR should provide assistance to all Sudanese refugees and asylum seekers.
    16. UNHCR should inform the Egyptian authorities (especially the police) about the rights of refugees and the treatment they should receive.
    17. UNHCR should take care of the minors, the elderly and women.
    18. UNHCR should reply individually to all enquiries and correspondence from Sudanese refugees and asylum-seekers.
    19. UNHCR should have fast-track procedures for refugee status determination and resettlement.

    Most of the demands of the Sudanese demonstrators are beyond UNHCR’s control. There are, obviously, some issues within UNHCR’s ability to influence but this can only be achieved through consultation and constructive dialogue, not by means of intimidation and the threat of violence. During the first meeting UNHCR had with the self-appointed leaders of the demonstration on 3 October 2005, they made it clear that they were not interested in discussing with UNHCR whatever grievances the demonstrators may have. They insisted that any discussions with UNHCR concerning their demands would only take place in the presence of representatives of the Egyptian government (Ministry of Foreign Affairs, Immigration and State Security), human rights NGOs, and the media. UNHCR explained to them that this was unrealistic but that the Office was happy to discuss with them matters that are within its mandate and capacities. However, the leaders of the demonstration refused UNHCR’s offer and any further contact with the Office. On 26 October 2005, UNHCR was finally able to organize another meeting with the protest leaders in the presence of representatives from a number of human rights organizations and church groups. After six hours of discussions led by the UNHCR Cairo Assistant Regional Representative, the protest leaders’ decision was an “all or nothing” response.

    It has come to UNHCR’s attention that a considerable amount of false and misleading information has been used in order to induce many Sudanese into joining the demonstration. The kinds of misrepresentations and rumors employed to generate interest in the demonstration include the following promises: UNHCR will reopen all closed files of unsuccessful asylum-seekers who take part in the demonstration; all those joining the demonstration will be resettled to the United States, Turkey and Australia; UNHCR is planning to force all Sudanese refugees to go back home; the Government of Egypt is charging US$ 300 each Sudanese refugee who wishes to remain in this country; at the end of the demonstration, every participant will receive “compensation” money from UNHCR. It is difficult to tell the real motives behind such deception and manipulation to rally protests against the United Nations refugee agency. UNHCR does not even know the identity and status of the five protest leaders, who have continuously refused to disclose their full names or produce UNHCR refugee registration documents if they possess one.
    Some of the demands of the Sudanese demonstrators are actually priority areas of concern to UNHCR, and have been for many years, for example, special assistance measures for minors, refugee women and the elderly, or training of relevant government officials, civil society actors, the media, etc. on refugee rights and obligations and State responsibility. A number of their other demands are actually allegations unsupported by any piece of evidence. For example, the claim that Sudanese security agents frequently abduct and torture refugees in Egypt is more self-serving than anything else. Why would the Sudanese Government be interested in southern Sudanese in Egypt who are only the victims of the 21 years civil war, which in any event has now come to an end. After all, Cairo is the headquarters of virtually all Sudanese opposition parties and they operate freely and openly. Concerning the allegations of disappearances, this may be explained to some extent by Sudanese who move to Libya or Israel in an irregular manner and are imprisoned (there are at present about 60 Sudanese ex-Egypt in Israeli prisons). UNHCR is also aware that spouse abandonment is quite widespread within the Sudanese community in Egypt and the lure of resettlement is, no doubt, an important motivating factor for this. This said, it is and remains UNHCR’s mandate responsibility to ensure that the fundamental prohibitions against expulsion and refoulement of refugees are fully respected.

    The key demand of the Sudanese demonstrators is “relocation” to a western country on grounds that Sudanese in Egypt “are faced daily with discrimination, violence and violations of their human rights.” Over the past several years, UNHCR has been actively promoting refugee resettlement not only because it serves an important humanitarian function, but also because it is a tangible measure of international solidarity and burden-sharing. Thanks to the generosity of resettlement countries, in particular the United States of America, Australia, Canada and Finland, some 17,000 Sudanese refugees in Egypt (predominantly southern Sudanese) have been resettled under UNHCR auspices in the last seven years. This is a significant achievement by any standard. It is not possible, though, to resettle all refugees from Egypt. Resettlement places are limited and refugees must meet strict criteria for admission, including recognition under the 1951 Convention. There are therefore some 14,000 Sudanese refugees remaining in Egypt, many of whom are former internally displaced persons from the south of Sudan who have been accorded refugee status in Egypt under the broader refugee definition of the OAU Convention.

    Egypt’s response to the protection needs of refugees, whatever their nationalities, has traditionally been generous. In particular, Sudanese in Egypt have for long enjoyed a status close to nationals on account of a number of bilateral agreements, such as the Nile Valley Agreement of 1976 which inter alia allowed for free movement of goods and persons across the common border. In those circumstances, UNHCR did not involve itself in registering and screening Sudanese asylum-seekers until March 1994 when the Egyptian Government requested the Office to undertake this task with a view to assisting the neediest among them.

    There is no doubt that the living conditions of refugees and asylum-seekers in Egypt are difficult. The majority of refugees and asylum-seekers live in Cairo dispersed throughout the depressed quarters of the city where they compete with poor Egyptians for scarce resources and limited jobs. However, refugees are not able to access free State education (except Sudanese), public health care, available social security and food subsidies partly because of the reservations entered by Egypt to the implementation of the basic socio-economic rights provided for in the 1951 Convention. The problem is though more a practical one: the economic and social situation prevailing in Egypt, where the demographic pressure is demanding substantial Government investments in public services (including basic education and health care), urban infrastructure, living facilities and employment opportunities. Recognizing this fact, UNHCR has had for many years a sizeable assistance programme for refugees in Egypt to help them meet their basic human needs. Sudanese refugees have been the main beneficiaries of UNHCR’s assistance programmes ranging from income support and health care to education for children, counselling services and skills development projects.

    Fortunately, most Sudanese refugees and asylum-seekers in Egypt do not have to endure any longer the difficulties of exile. With the signing of the Comprehensive Peace Agreement between the Government of Sudan and the Sudanese People’s Liberation Movement (SPLM) on 9 January 2005, Africa’s longest-living civil war has finally come to an end and the new era of peace is giving rise to real hopes for the return home of millions of southern Sudanese refugees and internally displaced persons. With the increased security in south Sudan, some 500,000 refugees and internally displaced persons returned home in 2004. Another 240,000 returned during the first half of 2005, and it is expected that by the end of the year this figure would have more than doubled to reach up to 580,000 returnees.

    Evidently, economic development and reconstruction of the infrastructure in South Sudan would be a long process and southern Sudanese refugees in Egypt and elsewhere would have to choose between life in exile or returning home and playing an important part in the reconstruction process. UNHCR is doing as much as it can with limited funds to improve conditions in south Sudan so that people who fled their homes during twenty-one years of civil war can return to their communities and restart their life. But UNHCR cannot, and should not be expected to, solve the problems of underdevelopment, unemployment or poverty. These are evidently problems for which UNHCR has no institutional responsibility.

    While, many of the reasons why southern Sudanese refugees originally left their homes no longer apply, substantial numbers of southern Sudanese continue to come to Egypt on a three-month tourist visa and subsequently approach UNHCR to register as asylum-seekers. Objective factors in south Sudan indicate that these people are generally not fleeing persecution or even generalized violence, but economic deprivation. They come to Egypt with the hope to find better living conditions, but the economic realities they find in Egypt will surprise many leading them to seek refugee status with UNHCR in the hope that this is the corridor to a new life in America, Australia or Canada. This is obviously a misuse of the international refugee protection regime.

    UNHCR considers that the situation of most Sudanese present in or coming to Egypt today should be approached primarily as an economic migration and development challenge and responses need to be located within bilateral relations between the two countries as established by, for instance, the “Four Freedoms” Agreement. There will, no doubt, continue to be some refugee and protection dimension (such as the situation presented by the ongoing violent conflict and human rights abuses in Darfur) and therefore a role for UNHCR to intervene as necessary and required.

    The procedures UNHCR currently has in place ensures adequate protection in Egypt for those fleeing the conflict in Darfur and, for that matter, any Sudanese who may be in genuine need of international protection. Sudanese nationals approaching UNHCR Cairo with application for refugee status are registered and provided with an Asylum-Seeker Registration Card (“Yellow Card”) with which they could obtain from the Egyptian authorities renewable six-months residence permits. By ensuring the temporary residence of refugee applicants registered with UNHCR, the Government of Egypt is clearly meeting its non-refoulement obligation – that is, the obligation under Article 33 of the 1951 Convention not to return a refugee or an asylum-seeker to a place where his or her life or freedom might be at risk. The fact that Sudanese refugee applicants, many of whom are in reality migrants seeking economic and social betterment, do not presently undergo individual refugee status determination at UNHCR Cairo has thus no adverse effect on the protection of bona fide asylum-seekers such as those forcibly displaced by the war in Darfur and seeking safety in Egypt.

    To conclude, the situation of the demonstrating Sudanese nationals, many of whom are not refugees as defined by the 1951 Convention or the 1969 OAU Convention, demands national legislation and/or policy measures outside the frame of refugee protection and indeed of UNHCR’s mandate. Experience shows that so long as certain basic necessities of life are not met in one’s country of origin, the imperative of survival will continue to prompt migration to another country irrespective of the barriers placed in its way or the risks or uncertainties involved. Many of those people who find themselves in such predicament do not fit within UNHCR’s mandate of international protection. However in Egypt, as in many other countries, UNHCR’s very presence makes it attractive to label such economic migrants as refugees so that they may get some assistance that is otherwise unavailable from the Government or any other source. It is this often deliberate blurring of the distinction between refugees fleeing persecution and migrants in search of economic opportunities that for the most part characterizes the Sudanese “protest” against UNHCR office in Cairo.
