    نزولا لرغبة القراء عامة والاخ سيف الدولة محمد احمد على وجه الخصوص ، لجهة عرض تفاصيل قضية الشنطة، فقد قمت بالاتصال ليلة امس بالاستاذ سيد عيسى المحامي للتعرف عما اذا كانت لديه التفاصيل الكاملة عن وقائع وحثيات تلك القضية .

    Judgment
    Advocate: Abdel Halim El Tahir………………. for the accused
    MA. Abu Rannat, C.J October 8, 1963:— A common prostitute by name Asha Mohamed Harun was until September 25 1962 living in a house in Omdurman, which she was sharing with other prostitutes On September 25, 1962 at about 7 p m. she left her house in the company of a man, and since that date she has disappeared and has never been heard of On October 4, 1962 an iron trunk containing the corpse of a woman was found in a hole inside the yard of accused’s house. The accused reported the matter immediately to the police at about 2:30 p.m. It is also admitted that accused’s house, which lies at Thawra Quarter of Omdurman, was only occupied by the accused and his family on July 9, 1962. Before that the house was vacant and occasionally occupied by labourers.
    The theory of the prosecution is that the accused was the boy.friend : of the deceased, that he was the person with whom the deceased left her house on September 25-1962 at 7 p.m., that he was known to the deceased women friends before her disappearance, that the deceased was murdered and that the accused was either the murderer or an abettor of the murder.
    The finding of the Court (one member dissenting) is that the corp which was found in the trunk was that of Asha Mohamed Harun, that slit. was murdered, that the accused was the person with whom she left her house on September 25, 1962, that there is no evidence to prove that he killed her or abetted her killing, but that he knew the murderer or murderers and screened them. The Court consequently. convicted him of an offence under Penal Code, s. 179 and sentenced him to imprisonment for three years.
    As confirming authority, I have to examine the. evidence carefully and see if the theory of the prosecution or the finding of the court is correct.
    In the case of Abdulla Abdel Rahman Nugdalla v. Sudan Government, (1954) Dig. Cr. App. No. 12, the Court of Criminal Appeal, of which I was a member, said:
    “ Unlike the Court of Civil Appeal, which will invariably uphold the findings of fact of a Court of first instance, provided there is sufficient evidence upon which the Court might reasonably so find, the Court of Criminal Appeal, as the final appellate and confirming authority of the country, without retrying the case has to consider independently the facts of every criminal case where the whole case is placed before it, and in exercise of an independent judgment satisfy itself as to the correctness of the convictions or reasonableness of the acquittals and the propriety of the sentences.
    “It is not for this Court to,disturb lightly the conclusions of fact of the Trial Court, which has studied the demeanour of the witnesses, and due weight has to be given to the fact that the Trial Court found certain witnesses reliable and others unreliable, but this does not believe this Court of its duty independently to examine the evidence for it’ as recorded in the trial papers, and to give such accused the benefit of any reasonable doubt which remains in the mind of this Court a such examination.”
    Bearing this in mind I shall deal with the issues raised in this case.
    The first point is whether the dead body which was found in the iron trunk is that of Asha Mohamed Harun.
    The Court found that the dead body was sufficiently identified by the deceased’s colleagues. The Court based its finding on the following points:
    (1) the incomplete hair dressing
    (2) burning mark on the forehead
    (3) . scars on the cheeks
    (4) general appearance and physique, and
    (5) . her clothes, namely the tob known as asrar.
    Some of the deceased’s colleagues who lived with her for nearly two years stated that they identified the body as that of Asha Mohamed Harun because they saw three tribal scars on each cheek, and a burning mark on her forehead. They also said that she was wearing a white tob known as asrar. The Court did not comment on the “fustan” and the shoes which were found on the trunk, as the witnesses did not make consistent statements about them.


    Against this evidence there is the evidence of Doctor Fatih, who examined the dead body carefully. He was more emphatic in his evidence than Doctor Khalil. who has been in practice for only one year. Doctor Fatih said on page 92 of trial record: “It was difficult to identify the face and I did not see any marks on it: I do not believe that there is room for anybody to see scars. It may be possible to identify the forehead if there was a mark on it. I did not notice any marks. It is possible for a person who knew the dead body to identify the scars if they were there. I do not think that it is possible for a person who saw the corpse at 4 or 5 pm. to identify simple scars, because I examined it under strong electric light.” On page 94 of the trial record he said: ..“I do not believe that it is possible for a col league or anybody who had known the deceased to identify the corpse in the condition in which I saw it.”
    As to the tob, the tailor who sewed it said it was not the one which he had sewn. Dahabaya also stated that she did not see the mark when she saw it in Court. As to incomplete hairdressing and false tooth, these may belong to any woman.
    Furthermore, the description of he garment and shoes which deceas ed’s colleagues gave to the police before the discovery of the trunk is different from the clothes and shoes found in the trunk.
    In my view there is doubt whether the dead body was that of Asha Harun. It may or may not be her body. It is very difficult for me to resist the evidence given by Doctor Fatih and the loopholes in the evidence of Asha’s colleagues. The second point, which is very important, is whether the accused was the person with whom Asha left her house on September 25, 1962.
    In order to decide this point it is necessary to examine the evidence produced before the Court.
    The identification parade. Leasing aside the irregularities referred to by the Court in its judgment, I do not think that the accused was identified by the prosecution witnesses. Superintendent of Police, Mohamed Abdel Gadir Ismail, who conducted the parade. stated that all the women with the exception of Hawa Adam Musa did not identify the accused. As to Hawa, he stated that he held three parades, that in one parade she picked El Kurdi, who was a suspect, and that in the two other parades where none of the suspects was put with the other men on the parade, she picked the accused. Furthermore, Superintendent of Police, Yahya Hussein, stated that when he showed the photographs bf accused and other suspects to Hawa, the latter was confused. In addition, two other women, namely Asha Ibrahim and Maryam Adam, picked a certain Mohamed Wali as the person who was one day drinking beer in the house of the deceased.
    This shows definitely that Hawa was not sure that accused was the boy friend of Asha. If he was the person who frequented her house, there would have been no difficulty in identifying him. If the story given by her and other prostitutes were correct, there would have been no difficulty in picking him out at the parade.
    Other, evidence of Identifacation The Court stated that Asha’s colleagues knew the accused before the incident. The Court stated that P.W. 7 and P.W.8 saw the accused in the house of Asha three times before the incident and believed their testimony. At the trial, P.W. 7 and P.W. 8 (Maryam Adam and Asha Ibrahim) stated that they saw the accused three times; on one occasion he came with a person called Sid Ahmed and on another occasion they drank beer in Asha’s house. at the identification parade (they did not identify the accused, and both of them picked another person, by name Mohamed Wali. When they were cross-examined they explained they knew the accused, but they did not pick him out as they were afraid of his relatives. No Court of Law would accept such explanation. as these women know perfectly well that they are under the protection of the police. Before the iron trunk was discosered, Maryam (P.W.7) told the police (pages 3-4 Case Diary) that she was told by Munira that deceased left the house in company of a tall and fat man who was wearing a dark suit. She did not mention the name of accused. If she really knew him, she would hase mentioned his name and given a correct description of his shape and occupation.
    At the trial, Munira (PW.6) stated that Asha went with accused, who was well known to her, but before the discovery of the trunk she made the following statement to the police (page 6 of the Case Diary)
    “After I left the bathroom, I heard a person knocking at the door. I asked whom do you want, and the person-asked me to call Asha for him .... When Asha opened the door, I saw a tall man medium in size wearing a suit the colour of which I do not know, nor do I know his colour, and if I saw him I could not identify him, because it was dark at 7 pm.”
    How can one believe the staement made by this witness at the trial, when she made such a statement at the time she was interrogated by the police and at a time when no one suggested that the accused was the murderer.
    Hawa Adam stated on page 5 of the Case Diary that the deceased went with a person who was fat (thick), tall, and dark in colour and Was wearing a dark suit. These descriptions do not correspond with the accused’s description.
    The first statement in the Case Diary is always preferable to statements made later, when the witness hears other people discussing the case and becomes influenced by their opinions.
    One important point which strikes me is that if these women really knew the accused as the alleged at the trial, they would ha naturally reported to the police that the deceased left her house in company of accused, The explanation that they were afraid of him or his relatives is most unsatisfactory, since he is not a man in authority.
    I should like to make it clear that I did not disbelieve the evidence of Asha’s colleagues because they are prostitutes or are of bad character. I did not believe them because they gave statements at the investigation which are different from those at the trial and magisterial enquiries.
    The next point is whether the dead body which was found in the trunk was killed.
    The Court found that Asha was killed. The Court disposed of this issue in a brief statement on the top of page 9 of the judgment (page 222 of the trial record). The Court gave the following reasons:
    “The fact that the corpse was kept inside an iron trunk under lock and key buried secretly in accused’s house, and the disappearance of the quite big lot of her golden ornaments, which had been worn by her, established beyond reasonable doubt the commission of a crime by someone, i.e., Asha Mohamed Harun Was brutally killed by someone. The fact that she was wearing her golden ornament is established by the testimony of P.W. 5 Hawa, P.W. 10 Tabeedi, P.W.9 and P.W. 8 Asha.”
    The fact that a dead body was found concealed in an iron trunk is a strong presumption that murder or a lesser offence leading to death was committed, but it was only a presumption. I agree with the principles referred to by the learned President of the Court and the various legal authorites quoted by him, but the important point here is whether these authorities are applicable to the facts of this case. The two doctors who saw the dead body did not give conclusive evidence that the deceased was killed. In fact their evidence shows that they were not sure that a crime in respect of the deceased was committed. In the circumstances the finding should be that murder or other offence was not proved beyond reasonable doubt.
    For the above reasons, and not for the reasons stated by the Court, I confirm the finding of not guilty under Penal Code, ss. 251 or 84/251.
    The last point is whether the conviction of accused under Penal Code, s. 179 is correct. Section 179 opens with these words:
    “Whoever knowing or having reason to believe that an offence has been committed
    This section is #####alent to Indian Penal Code, ss. 202 and 212. 2 Gour, Penal Law of India 1056 (7th ed 1961) states:
    “ In order to make a person liable under the section there must be, in the first place, the commission of an offence. Hence, the first thing to be proved is that an offence had been committed by the person har boured and, until he is convicted of the offence no prosecution can be launched under (Indian Penal Code] Sec. 212 fot harbouring the offender.”
    I think Gour goes too far when he says that unless the person har boured is convicted, no prosecution can be held. It is sufficient in the Sudan to prove that an offence has been committed, whether by the ac cused or any other person, but the important point is that an offence must have been committed.
    As stated above, Penal Code, s. 179 postulates the commission of an offence, and I am unable to say with certainly that the deceased was killed. This alone renders the con’ a nullity.
    I do not want to stop here, as I feel it is necessary to show if the accused has anything to do with the burial of the deceased in his house.
    The evidence shows that accused’s mother-in-law ordered the accused’s servant to dig a hole in the house for an innocent purpose, and that while the servant was digging the hole, he found the iron trunk buried there. The accused arrived from his office at about 2 p.m., and when he saw the trunk he immediately proceeded to the Police Station and reported the matter at 2:30 pm This is in favour of accused, who did not try to remove the trunk or take other steps to conceal it. The prosecution contends that it is impossible for any other person without the knowledge of the accused to dig a grave in his house and bury the trunk containing the corpse there. Two points must be cleared: that either the corpse was buried before July 9, 1963, the date on which accused occupied his house, or that there is a possibility for some other people to bury it while the accused and his family were not in the house. It is not necessary that the digging of the grave and concealment of the trunk was on the night of September 25, 1962, as the time of death was not established.
    As to the first point, Doctor Fatih stated in his report that no definite timing could be given, and concluded by saying that in this case the shortest approximate time for adipocere would be three weeks or even much more. In his report Doctor Mansour stated that in his opinion such a state of putrefaction could possibly occur in this case at any time after the end of the first week. In his evidence Doctor Mansour (p. 104 of the record) stated that the minimum period for putrefaction is after the first week from burial. He also stated on p. 108 of the record that if the person was rolled in cotton clothes or buried in a dry and hard soil, putrefaction is delayed. He added that Thawra Quarter of Omdurman, where the accused’s house is situated, is dry and stony.
    Smith and Fiddes, Forensic Medicine28 (10th ed. 1955) states:
    “The effect of air in accelerating putrefaction is also seen in bodies which have been buried; for example, in air-tight coffins the body remains with very little change for long periods, while bodies buried without coffins putrefy at once; similarly, bodies in deep graves putrefy much more slowly than those in shallow ones.”
    It has been established that the trunk was air tight, that the place was rocky and dry and that no bad smell was smelt by any person before the trunk was unearthed. It is probable in the circumstances that the burial took place before the house was occupied by accused. At least there Is reasonable doubt that it was buried in the house after September 25, 1962.
    As to the second point, it has been proved that two persons can dig the pit in which the trunk was found in 45 minutes. There is evidence that the back door was not always locked. The accused’s family alleged that they never absent themselves from the house, but they may have asserted this to prove that the trunk was concealed before they occupied the house. What is possible is that somebody who knew the movements of family did it. There could be such an opportunity, as it is easy to bring the trun in a car without attracting the attention of the neighbours and with the assistance of other persons dig the grave and bury the trunk. All this Is possible and it is very dangerous to Jump to the conclusion that as accused was occupying the house, he should have known the persons who buried the corpse.
    For these reasons, I refuse confirmation of the finding of guilty under Penal Code, a. 179 and direct that accused be set at liberty forthwith.
    The case was really a difficult one and the Court did Its utmost to get the facts clear.
