Press Release of Bahar Idris Abugarda

I am delighted that Pre-Trial chamber 1 of the ICC today unanimously decided not to confirm the charges that the prosecutor brought against me in connection with attack on the AMIS base in Haskanita. I am particularly happy that the unanimous decision not to allow the matter to proceed to trial was taken on the basis that there was insufficient evidence to connect me to any plan to commit a crime or the commission of any crime alleged.

I have always maintained my innocence and was therefore happy to surrender to the jurisdiction of ICC, confident in the impartiality and integrity of the ICC judiciary. The decision has been fully vindicated. I stand ready to appear before the court again should that ever be required by judges of the ICC in the future. I am not responsible for any crime within the jurisdiction of the ICC and hope that the confirmation decision will mark an end to attempts to tarnish my name or unfairly and wrongly implicate me.

I cannot end this press release without standing my belief that this confirmation decision should give comfort to anyone else whose appearance before the ICC is sought. That they will    get a fair hearing before an independent and impartial Bench of judges.

I now look forward to focusing my attention to what is most important to me: the search for lasting peace in Darfur where all individuals can live in a society where the rule of low prevails and where hope replaces fear.

My legal team is still studying the decision and I would like to reserve future comments until such time as they have had a proper chance to consider the decision and its implications.
