Rape .. Under Shari'a law

The entire Sudanese nation, men and women, old and young, stood up in admiration and respect to salute their courageous daughter and sister, Ms. Safiya Ishaq.The graduate of fine arts who, in a rare act of bravery, foretold in a YouTube video clip that was widely published throughout most of the Sudanese websites. Al Hurra TV channel also showed how three security men kidnapped Safiya from the center of Khartoum, how they had beaten and tortured her inside one of their completely isolated and scary offices, near Shendi bus station in Khartoum North. The three of them rotated in raping her in brutality, and bestiality that can only be exercised by the sick and the psychopaths.
If Safiya only cared for her reputation, feared what people may say about her, got scared of repetition of the raping, or felt ashamed of talking about it, she would have never been able to reveal such a sick behavior that is alien to the decent nature of the Sudanese people. Safiya bravely gave her testimony on the details of the incident and officially initiated a legal police case open for investigation. Moreover, she voluntarily chose to record a video clip for YouTube as a permanent testimony and for historical record. The assaulters are coward enough not to respond to the raised public claims, which confirmed the authenticity of the sad story.
A group of concerned citizens visited the family of Safiya and discussed with them the sensitive implications of the case and provided inspiration that can make them proud of their daughter and hence issue a retaliation claim, rather than blame her for what has been forced over her. The visit was also to assert that honorable Sudanese people, who are keen on high morality standards, consider Safiya’s reaction as dignified and noble. In fact, she has sacrificed every suffering she may go through from talking about the case for the sake of rescuing other Sudanese girls from probable assault by the security officials. By doing so, Safiya had actually raised the challenge banner high enough that assault victims may no longer be scared or ashamed. That was a condition, upon which the criminals have highly depended on to continue raping the young activist girls while firmly kept unvoiced.
When the sons and daughters of Sudanese people condemned and categorically denounced the brutal flogging of a girl, caught on video and exposed in all avenues of internet and print media a few months ago, some of the leaders of the National Congress, claimed that what happened to the girl, was consistent with the application hudud (affirmed Shari'a puishments) commanded by Allah, and that it is not right for a Muslim to object to the application of the Shari'a! This happened despite the fact that the flogging has been by fifty lashes, a number which is not specified in any of the hudud punishments! Although the President has said the Shari'a law will be applied after the secession of the south, and that specific incident was before! Now we condemn the rape of our daughter Safiya Ishaq, as we condemn all the harm that was inflicted on her. We wonder what will the leaders of the National Congress tell us this time? Is it permissible in the state under the rule of Shari'a, where women are flogged simply for wearing pants, that higher state officials in charge of security commit the most immoral crimes, including forced adultry and rape of free women? Does the government want the people to accept all this and keep silent on the violatioins and atrocities against their daughters, just because the National Congress conveyed to them the good news about the upcoming application of Shari'a laws? If we are to believe the argument that the government said those individuals were not representative of the government nor its ruling party, and they did not order the suppression of demonstrations by using rape as a weapon to terrorize women, the government should have removed these officials from office and brought them to trial immediately! As long as the Sudanese state is applying Shari'a law, as alleged by the leaders of the National Congress, then the rule of Shari'a must be applied to these criminals, in order for them to be examples to others, and we must also take the opinion of religious scholars, who believe that rape is included int te code of corruption in the land. This was specifically stated in the Qur'an verse of banditry in which Allah the Almighty said: "The punishment for those who wage war against Allah and His Messenger and strive after corruption, making mischief in the land [those who refuse to surrender to Islam] is murder, execution, crucifixion, the cutting off of hands and feet on opposite sides, or they should be imprisoned. That is their degradation and disgrace in this world. And a great torment of an awful doom awaits them in the hereafter."(Qur'an 5.33 . As it is well-known to most schollars, that those who would be punished by excile are the criminals who terrorise people and rape them without taking their money!
There is a systematic injustice and oppression targeting the Sudanese women associated with claiming the application of the Public Order Act, which was revealed by the case of the journalist Lubna Ahmed Hussein, whom they tried, and wanted to flog for simply wearing the "pants" .. Then when she resisted the trial, and aroused the public opinion, at home and abroad, the government backed away from the flogging and opted to a fine, and when she refused to pay the fine as an act of escalation of her resistance, she was sent prison for one day before a prominent powerful member in the government's party paid the fine, and released her from prison, while the flogging and the imprisonment of other women was executed for the same charge!! Not only this but even the women who, in a sign of solidarity with her, gathered outside the court, were beaten by police with batons, as they were arrested during the day for several hours .. A short period after that, Silvia, a Southern Christian girl under the legal age, was flogged for wearing "pants", without been asked about her age, or religion, questions which would have precluded her from punishment if they were asked .. The number of Sudanese women who have been subjected to humiliation by imprisonment and flogging because of the Public Order Act reached 43 thousand women in 2008, according to public prosecution statistics.. Then the video girl was flogged in an arbitrary, barbaric, and brutal manner, in the street, by two police officers, rather than a policewoman in a hidden in a place .. Almost unanimous and various Sudanese sympathasized with her. Women felt that the beating in that brutal way was an intended message addressed to them, from the government, that the oppression of women was purposely conducted, so they objected to it and rose to write against it.. Now, comes the incident of Safia, the worst and the last stage of the assault by the authority on Sudanese women, targeting the highest values of this noble people, the honor and chastity of women.
When international sources, especially human rights organizations, talked about the crimes of rape committed against many in Darfur, by the Janjaweed, with the backing of the government, as well as by considerable members of the regular troops, the Sudanese people denounced these heinous crimes, while the government and the leaders of the National Congress immediately denied the news .. Their denial was based on the fact that raping of women is not an attitude of the Sudanese people. This is definitely true, but not everyone who lives in the Sudan preserves and abides by the ethics of the Sudanese people, especially those who have special interests and cannot resist the lure of of big financial rewards which made them sacrifice those values. Such government's endeavors to cover the rape crimes was bought by many Sudanese, but by the the people of Darfur, who insisted on the existence of cases of rape of many, where the victims, in fear of the society , did not speak of what happened to them. Nevertheless, the National Congress, insists on denying the occurance rape, even though it did not deny the occurance murders, atrocities, and displacement of refugees, as a result of the war.
Safia has spoken about what happened to her in a Youtube video, put for several days in many websites on the Internet, as it was shown on Al Hurra TV channel. Legal procedures were also initiated, however, The National Security apparatus did not issue any statement to deny or confirm the incident, or at least say that it is being under investigation! Should we assume the reason is that they did not hear the news?! We have neither heard the opinion of the judiciary, or any governmental official speak a word about it, as if the government wants to kill it with silence until it is forgotten .. Or maybe it considers all of what is happening targeted members of the opposition, about whom it does not care, because they deserve everything that happens to them!
The government has recently taken positive actions, including putting a stop on the expected rising prices, the formation of a commission to fight corruption, as well as starting to refer some of the files related to tcorruption to the courts, planning to employ the graduates, taking measures to organize a referendum for the people of Darfur, the distribution of funds directly to the needy individuals of poor neighborhoods by the People's Committees .. But what about freedom? The people who are rising up against their governments around us, are not all poor, complaining about unemployment or the high cost of living .. they are demanding fundamental rights and freedoms, which our government still miserably falls short of. The oppression, tyranny, and torture of detainees, which amounted to such levels of crimes against honor, are the greatest spur to the revolution. Otherwise the Governmen must take this matter seriously enough to cleanse its organs of these criminals and corrupt people, and commends rebellious Safia who has paid so dear to reveal the disease. If this government was not involved in the approval, to opress its people, even by torture and rape .. If the Government agrees with what is happening, and that the security officers were merely carrying out its orders, for which it would protect them, defend them, and would not allow legal measures to be taken against them, then any other reforms will not workt.
