Just what is Luis Moreno Ocampo after?
Just days after the court approved his application for an arrest warrant against Sudanese President Omar al Bashir for war crimes and crimes against humanity -- provoking a vindictive government reaction that's undoubtedly endangered more lives -- Moreno Ocampo apparently isn't satisfied. He's asking the judges to go back and include three counts of genocide to the charges against Bashir.
Genocide is the most serious charge that the war-crimes court can level, and the bar for proving it is rightfully high. The judges decided by a 2-1 margin that Moreno Ocampo didn't have the evidence to prove Bashir committed genocide in Darfur, but they left the door open to adding that charge if they saw more evidence. Moreno Ocampo argues that the majority applied an unnecessarily high legal standard -- a contention shared by at least one leading legal blogger.
I'll leave the legal arguments to the lawyers. But I know enough to say this about the prosecutor: his timing stinks, and risks making things even worse in Darfur.
The Sudan scholar Alex de Waal says that Moreno Ocampo's "complaint seems to resemble that of a student who has been given a fail grade, arguing that the examination board should have set the mark needed for a pass at 25% and not 50." I think the prosecutor is more like that annoying kid at my high school who got a 1560 on his SAT and whined about not getting the perfect 1600.
A 1560 earned you admission to any university you wanted, not to mention the universal hatred of the senior class. There's nothing to be gained by the additional 40 points. Likewise, Moreno Ocampo has his milestone, putting Bashir on a list with Charles Taylor and Slobodan Milosevic as the only sitting ######### of state to be charged with war crimes, a key first for the young court and a huge black mark against a dictator.
Why push for the genocide charge now?
Bashir isn't going to court anytime soon. Sudan's response to the warrant for war crimes and crimes against humanity was to ban 16 major relief agencies, the backbone of a huge humanitarian operation that has saved untold numbers of lives in Darfur. The reaction from African and Arab states -- the ones most able to apply pressure on Sudan to have Bashir face charges -- has been, predictably, to scream Western conspiracy and vow to ignore the warrant.
Reasonable people disagree over whether what happened in Darfur was genocide. To me, the argument is one for the classroom, not something that 3 million people who've fled their homes care about right now. And it is difficult to argue that Moreno Ocampo hasn't made things worse in Darfur, at least in the near term. Rather than being cowed, Bashir appears to be digging in: today he said that all international aid groups should stop their operations in Darfur within a year. It may be the last throes of a regime in crisis. But a lot of people could die.
It's not too late for the prosecutor to show he's not singling out the Sudanese government. There have been atrocities on all sides in Darfur, including by the rebel groups. Moreno Ocampo is reportedly investigating the deadly 2007 rebel attack on peacekeepers at Haskanita. Rather than seeking leave to press his case against Bashir, this would be a good time to push his case against the rebels.
It would take some of the wind out of the claims of a Western plot against Sudan. It would show that the court isn't some airy academic experiment, ignorant of the messy politics of this complicated country and region. It would be the right thing to do. And it might even increase the likelihood of Bashir having his day in court -- a probability that I would not bet on right now.
The prosecutor isn't wrong that justice should be blind. But it also has to be fair.
