On 10 November, the Khartoum Criminal Court sentenced 10 people to death for the murder of journalist
Mohammed Taha. One of those facing execution is 16 years old. All defendants in the case had allegedly
been tortured to give confessions, which were used in court as evidence against them.
The 10, including Al-Tayeb Abdel Aziz who was then aged 15, were arrested during a murder investigation
into the killing of Mohammed Taha, the editor of the newspaper al-Wifaq, who was found beheaded on 6
September 2006. During their investigation into this case the police focussed on the Darfuri community
living in Khartoum, and rounded up some 72 people, including women and their children, originating from the
Darfur region.
Reports suggest that nearly all of those arrested were beaten and otherwise tortured to obtain confessions,
by police and also by the National Intelligence and Security Services. After up to five months in detention
most of the 72 detainees were released. A total of 19 defendants were brought to trial. All defendants
retracted their confessions in court, saying that they were extracted under torture. Defence lawyers asked for
medical examinations into their torture, but these were refused, even though many of those detained
reportedly carried marks of torture on their bodies. In August 2007, nine of the detained were acquitted after
the judge said that the evidence against them rested solely on confessions made under duress.
All the 10 who have been sentenced to death have reportedly stated that they were tortured. One of the
group, Hassan Adam Fadel, said that he was beaten all over his body, tied up and left outside in the sun for
hours. The security forces allegedly used threats against wives, mothers and children, some of whom were
detained, to put pressure on the detainees to confess: one detainee reportedly stated that his mother was
shown to him naked. Amnesty International is concerned that the use of torture to extract confessions is built
into the Sudanese system of justice by Article 10(i) of the Law of Evidence of 1993 which states that “…
evidence is not dismissed solely because it has been obtained through an improper procedure, if the court is
satisfied that it is independent and admissible.”
Amnesty International opposes the death penalty unconditionally in all situations as a violation of the right to
life and the ultimate cruel, inhuman or degrading punishment. The use of the death penalty against child
offenders, people who were under 18 at the time of the crime, is prohibited under international law. The
International Covenant on Civil and Political Rights (ICCPR) and the Convention on the Rights of the Child
(CRC), both have provisions exempting this age group from execution. Sudan has a responsibility to adhere
to these international laws.
BACKGROUND INFORMATION
Mohammed Taha was an outspoken newspaper editor who had also angered Islamists after writing an
article discussing the ancestry of the Prophet Mohammed, after which he was arrested by the security
services. He was also said to have written articles attacking Darfuris.
RECOMMENDED ACTION: Please send appeals to arrive as quickly as possible, in Arabic or English
or your own language:
- expressing shock at the decision of the Khartoum Criminal Court to impose the death penalty on 10 people,
and at the fact that these sentences were imposed largely on the basis of confessions obtained under duress;
- calling for allegations of torture to be investigated, and any security official who is found to have used
torture to be brought to justice;
- calling on the authorities to abide by their obligations under the International Covenant on Civil and Political
Rights and the Convention on the Rights of the Child, Article 37 of which states that “No child shall be
subjected to torture or other cruel, inhuman or degrading treatment or punishment. Neither capital
punishment nor life imprisonment without possibility of release shall be imposed for offences committed by
persons below eighteen years of age”;
- emphasising that the authorities have a right and a duty to try those accused of violent crimes but that
defendants must be given fair trials;
- stating your opposition to the death penalty which is the ultimate cruel inhuman and degrading punishment
and is a violation of the right to life.

العزيزة ندي
نبرأ لله من ما تمارسه هذه السلطة الغاشمة و اجهزتها الكرونية.. هذه تصرفات عنصرية قبيحة تسيئ للانسان علي الهوية و الانتماء العرقي و الجهوي.. باي قانون يحاكم عشرة اشخاص بالاعدام بزعم اشتراكهم في اغتيال شخص فرد.. عمليا و منطقيا لا يقبل ادعاء اشتراك العشرة بنفس الدرجة و المشاركة الجنائية ليصدر اقصي عقوبة كحكم يتساوا فيه جميعا.. كذلك اعتقال سبعين فرد من عائلات المتهمين بما فيهم اطفال و نساء و شيوخ, يمثل سابقة تدل علي مدي تدهور الاجهزة الامنية و العدلية في الوطن المنهوب.. نرفض مجمل ما حدث و نعتقد ان هذه الاحكام لا تصدر الا من نظام يشبه عصابات المافيا, لكنا نقف امام منطقية و عدلية اعدام طفل وقت الحادث لم يتجاوز عمره 15 عام,, و شيخ سبعيني!!.. هذه العصابة الحاكمة تستهين بدماء و ارواح البشر و تتحكم فيها نزعات عنصرية حقيرة,, و هي بتجاوزاتها و جرائمها الخطيرة تسعي لفت عضد الشعب و ترسيخ العنصرية و القبلية كبديل للانتماء الوطني و ترسيخ تعاقد و قبول مشترك كشروط للتعايش السلمي...

خطوة في الإتجاه الصحيح .... لكن لا تكفي ....
فكما كتبت يا أخ محمدين أن هناك إعتقالات الآن لكثير من أبناء دارفور بالعاصمة و تعرضهم للتعذيب ...
يا عالم .... الإعلام اليوم و بالذات إعلام الإنترنت و الإيميل هو بمثابة الأنوار الكاشفة التي تسلط الضوء علي المجرمين فيتجمدون في أماكنهم .
يجب إرسال معلومات هؤلاء العشرة الي كل الجهات و ليس في الخفاء ... بل إعلان كل التحركات هنا في المنبر و كل مواقع الإنترنت المتاحة ...
الصمت هو الذي يقتل الدارفوريين في كل مكان .
و لا تنسوا ... أن محاميي هؤلاء العشرة يمكن أن يكونوا هم أيضا هدفا لهؤلاء المجرمين ...
و علينا بحمايتهم ... و عليهم بحماية موكليهم .... فالصمت لا يخدم غير النظام الأبارتيدي ...

لتونا إنتهينا من إجتماع بالتلفون conference call عدة دارفوريين مع ممثل من سيف دارفور ...
و تطرق الإجتماع الي موضوع ضرورة فعل شئ ..
و كان أحد الذين حضروا الإجتماع له إثنين من أقاربه ضمن هؤلاء العشرة ..
و طلب منه ممثل سيف دارفور ( الحقيقة كانوا إثنين ممثلين ) إعداد خطاب به معلومات كافية عن العشرة .
و لقد كانوا ملمين بأمر حكم المحكمة علي الدارفوريين .
و لقد أقر الجميع بضرورة التحرك السريع و الواسع لتحجيم قرار الحكومة و إعلامها بصروة أو أخري أنها ستكون مسؤولة مسؤولية مباشرة عن كل ما يلحق الدارفوريين العشرة و غيرهم في العاصمة من أذي .
لكن و هذا ما ظللنا نردده دائما : لكي تساعدك المنظومة ... يجب أن تساعدها اولا بالحقائق اللازمة ..

تحية طيبة، و كما كتبت، لا بد من تصعيد الجهود لايقاف هذه المهزلة:

الاخت ندى
حكى لى احدهم بانه فى اليوم الذى فصل فيه راس محمد طه عن جسده كان البشير فى جولة تفقدية بطائرة عمودية الى مشروع حلفا الزراعى وفور تلقيه النبا قطع جولته وعاد الى الخرطوم
اتعلمين لماذا فعل ذلك ؟
لانه اعتقد بان وراء حادث القتل ما هو اكبر من مجرد اغتيال صحفى لقد اعتقد بان هناك من يهدد سلطته
ولانه استولى على السلطة عن طريق الانقلاب ربما اعتقد ان ثمة انقلاب يدبر ضده فى تلك اللحظات خاصةاذا علمنا ان محمد طه محمد احمد كان يمثل دور الكلب المسعور للنظام عبر صحيفته الوفاق وان البشير كان سعيدا بقيامه لهذا الدور على اكمل وجه
انا حزين جدا لمصير العشرة وبالذات للشاب الذى لم يبلغ الثامنة عشرة بعد
ثم اذا سلمنا بانهم مذنبون الم يشتم محمد طه الدارفوريين باقذر النعوت فقط لانهم حملوا السلاح فىوجه سلطة غير شرعية
ولماذا لم تتحرك السلطة لايقافه
بالطبع لانه جزء منها وان هذا بالضبط كان هو الدور الذى طلب منه القيام به

DARFUR REHABILITATION PROJECT, Inc. (DRP) appeals to your wisdom and requests that you would personally review the decision of the Khartoum Criminal Court to impose the death penalty on ten people, including a youngster, for the murder of Mohammed Taha.
Considering that these sentences were imposed allegedly on the basis of confessions obtained under duress, DRP respectfully requests that the allegations of torture be thoroughly investigated. Should the findings indicate that any security official used torture to obtain false confessions, DRP urges that the resultant vigorous efforts effect justice upon those who would so recklessly undermine the corporate confidence placed in them to perform their duties in a responsible and acceptable manner. As a member of the world body, DRP looks to your authority to encourage the Court to abide by the obligations set under the International Covenant on Civil and Political Rights and the Convention on the Rights of the Child, Article 37, which states, "No child shall be subjected to torture or other cruel, inhuman or degrading treatment or punishment. Neither capital punishment nor life imprisonment without possibility of release shall be imposed for offences committed by persons below eighteen years of age".
Of course, it is recognized that the Court has a right and responsibility to try those accused of violent crimes; however, this authorization carries also the power to treat defendants in an humane and judicious way. As such, the death penalty which is the ultimate cruel, inhumane and degrading punishment as well as a violation of the Right to Life has no place in these deliberations. DRP would appeal to your wisdom to support this notion and to use your skill of persuasion by entering a petition to the authorities on behalf of the ten defendants to have the death penalty discontinued.
